RENTAL TERMS & CONDITIONS
These Rental Terms & Conditions (the “Agreement”) govern the rental of garments and accessories (collectively, the “Items”) from Brooklyn Vintage Archive (“Brooklyn Vintage Archive,” “BVA,” “we,” “us,” or “our”) by you, the customer (“Renter,” “you,” or “your”).
By submitting a rental request, paying for a rental, or taking possession of any Item, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
1. PARTIES
1.1 Lessor. Brooklyn Vintage Archive (“BVA”) is the owner and lessor of all Items made available for rental.
1.2 Renter. The “Renter” is the individual or entity that submits the rental request and is financially responsible for all fees, charges, and obligations related to the rental, including any additional charges described in this Agreement.
2. HOW IT WORKS
2.1 Project Creation. When you visit www.brooklynvintagearchive.com, you may start a new project, assign it a name, and use it to organize Items for your rental purposes.
2.2 Browsing & Selection. You may browse the archive and either:
- Add Items to your favorites for future use; and/or
- Add Items directly to your project for consideration.
2.3 Rental Dates. At checkout, you will select your desired rental date range (the “Rental Period”).
2.4 Studio Visit (Optional).
If you need to see selected Items in person before renting, you may book an in-person studio visit for a non-refundable appointment fee of $50, which is scheduled before checkout through www.brooklynvintagearchive.com.
2.5 Approval. All rentals are subject to approval by BVA in its sole discretion. Your selected Items and project details will be submitted to BVA for review. BVA reserves the right to reject any project or specific Items for any reason.
2.6 Payment & Confirmation.
Once your project and selected Items are approved, your card will be charged the full rental amount. Only upon payment and confirmation from BVA is your rental considered booked. You are then responsible for arranging pickup (or courier) and drop-off time(s) within the approved Rental Period.
3. CONDITION OF ITEMS
3.1 Condition Upon Receipt.
Unless otherwise specified in writing by BVA at the time of rental, the Renter acknowledges that each Item is in excellent condition upon receipt, taking into account its vintage nature and any pre-disclosed flaws or patina.
3.2 Inspection.
Renter agrees to inspect all Items immediately upon receipt and notify BVA in writing (with photos, if possible) of any discrepancies or concerns within 24 hours. Failure to do so will be deemed acceptance of the Items “as is” as described at the time of rental.
4. OWNERSHIP & PERMITTED USE
4.1 Ownership.
All Items remain the sole property of Brooklyn Vintage Archive at all times. Rental does not transfer ownership or confer any rights of sale, reproduction, or duplication of the Items.
4.2 Not for Sale.
Archival Items are not for sale unless explicitly designated as such by BVA in writing.
4.3 Approved Project Use Only.
Renter agrees that all rented Items are to be used solely in connection with the specific project and usage described and approved by BVA at the time of rental (for example: film/TV production, editorial shoot, designer inspiration, lookbook, etc.).
4.4 Unauthorized Use.
If BVA discovers that Items have been used for any purpose outside the agreed and approved project (including but not limited to personal use, unauthorized events, reshooting, or sub-rental), BVA reserves the right to impose an additional fine or fee in an amount determined at BVA’s reasonable discretion, which may include up to the full market value of the Items as listed on the product page(s).
5. FEES, PAYMENT & ADDITIONAL CHARGES
5.1 Rental Charges.
Your card will be charged the full rental amount once BVA approves your project and selected Items.
5.2 Studio Visit Fee.
A $50 non-refundable appointment fee applies if you request a studio visit to pre-approve clothing before rental. This fee is paid at the time of booking via www.brooklynvintagearchive.com.
5.3 Late Fees.
If Items are not returned by the agreed-upon return date and time, and an extension has not been negotiated with BVA prior to that return date, a late fee of $50 per day per order (or as otherwise specified in writing by BVA) will be charged to the Renter’s card on file.
5.4 Non-Return / Extended Non-Compliance.
If the Renter fails to return the Items within the Rental Period and does not respond to BVA’s attempts to coordinate an extension or return, BVA may:
- Charge the full market value of each unreturned Item, as specified on the product page at the time of rental, to the Renter’s card; and
- Treat such charge as non-refundable, unless otherwise negotiated in writing with BVA prior to the charge.
5.5 Cleaning & Soiling.
Renter agrees to handle all Items with care. If an Item is excessively soiled or stained, BVA may charge the Renter for the actual cost of professional dry cleaning and any associated restoration services. Ordinary, minor wear may be considered acceptable at BVA’s discretion.
5.6 Damage & Loss of Value.
If an Item is lost, destroyed, or returned with damage that:
- Depletes its market value;
- Is difficult or impossible to repair; or
- Involves missing components (e.g., buttons, embellishments, matching pieces, accessories),
then, at BVA’s sole reasonable discretion, the Renter will be charged up to the full market value of the Item as stated on the product page at the time of rental, in addition to any rental fees already paid.
BVA will determine whether the damage is repairable and, if so, may charge:
- The actual cost of repair; and/or
- An appropriate diminished-value fee, up to the Item’s full market value.
5.7 Payment Authorization.
By entering into this Agreement and providing payment details, Renter authorizes BVA to charge the card on file for:
- Rental fees;
- Studio appointment fees;
- Late fees;
- Cleaning fees;
- Damage, loss, or diminished-value charges; and
- Any additional charges permitted under this Agreement.
6. PICKUP, DROP-OFF & COURIER
6.1 Renter’s Responsibility for Logistics.
The Renter is responsible for arranging and paying for pickup and drop-off of the rented Items, whether in person, via courier, or via any third-party service.
6.2 Courier Delays.
BVA is not responsible for any delays, loss, or damage caused by couriers, shipping providers, or third-party handlers before, during, or after the Rental Period. It is the Renter’s responsibility to schedule adequate transit time and secure appropriate insurance, if needed.
7. PROJECT APPROVAL & RIGHT TO REFUSE
7.1 Right to Reject Projects.
Brooklyn Vintage Archive reserves the right, in its sole discretion, to reject any project proposal or rental request, or to limit the number or type of Items approved for a particular project.
7.2 Changes to Projects.
Any changes to project scope, usage, or dates must be communicated to, and approved by, BVA in writing. Additional fees may apply.
8. LIABILITY & INDEMNITY
8.1 Assumption of Risk.
Renter understands and agrees that vintage and archival Items are delicate and may require special care. Renter assumes full responsibility for the use, handling, and storage of all rented Items from the moment of pickup until they are received back by BVA.
8.2 Limitation of Liability.
To the fullest extent permitted by law, BVA will not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with this Agreement, including any delays, cancellations, or production losses.
8.3 Indemnification.
Renter agrees to indemnify, defend, and hold harmless BVA and its owners, employees, and agents from and against any claims, damages, liabilities, costs, and expenses arising out of:
- The Renter’s use of the Items;
- Any breach of this Agreement; or
- Any third-party claims related to the Renter’s project or production.
9. TERM, TERMINATION & CANCELLATION
9.1 Term.
This Agreement applies from the moment the Renter submits a project or rental request and continues through the completion of the Rental Period and return of all Items (including resolution of any additional fees).
9.2 Cancellation by Renter.
Renter cancellations may be subject to partial or full forfeiture of rental fees, depending on timing and BVA policy in effect at the time of booking. Any studio visit fees are non-refundable.
9.3 Termination by BVA.
BVA may cancel a confirmed rental and refund applicable rental fees if, in its sole discretion, the Items are unavailable due to prior damage, loss, or other unforeseen circumstances, or if BVA determines the project to be high-risk or misrepresented.
10. GOVERNING LAW & MISCELLANEOUS
10.1 Governing Law.
This Agreement will be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
10.2 Entire Agreement.
This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, or representations, whether oral or written.
10.3 Amendments.
BVA may update these Terms & Conditions from time to time. The version in effect at the time of your project approval and payment will apply to that specific rental.
10.4 Severability.
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
10.5 No Waiver.
Failure by BVA to enforce any provision shall not be construed as a waiver of any right or provision.
11. ACKNOWLEDGMENT & ACCEPTANCE
By doing any of the following, you acknowledge and agree to be bound by these Terms & Conditions:
- Submitting a project through www.brooklynvintagearchive.com;
- Clicking an “I Agree,” “Accept,” or similar button associated with this Agreement;
- Paying for a rental after BVA approval; and/or
- Taking possession of any rented Item from BVA.
